Any terms underwritten with a maximum underwriting fee other than what is provided for in Paragraph (5) shall be the obligation of the underwriter; (7) The underwriting fee shall not be available to be used under this Act while the Village is under any public financing or under the authority of any public or private offering of debt instruments to be issued pursuant to the provisions of this Act. (8) The maximum underwriting rate for new construction projects is 4.75% and the maximum underwriting rate for renovation and enhancement projects is 3.75%. If the applicant for financing requests a rate less than that, the underwriting fee shall be that lower rate, but not less than 4.75%; no new project may be financed under this Act until the approval of a new project financing agreement by the Village finance committee of the Village Board.
